Сохранить право супруги и новорожденного ребенка на нахождение в России без выезда можно через продление срока пребывания по статусу члена семьи студента согласно ст. 5 Федерального закона № 115-ФЗ. Транзитная виза выдается строго для выезда из страны, и после ее оформления урегулировать статус матери внутри РФ уже не позволят. Выезд по такой визе при закончившемся сроке прежних документов влечет риск запрета на въезд в РФ, поэтому до согласия на транзит подается мотивированное заявление о продлении срока пребывания по рождению ребенка.
